2. PURPOSES: For what purpose do we process your personal data?

In compliance with the provisions of Regulation (EU) 2016/679, the General Data Protection Regulation (“GDPR”), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”), we inform you that MWCapital processes your personal data for the following purposes:

  1. 1. To send commercial communications via email or WhatsApp containing informational, commercial, or advertising content related to the activities, initiatives, or programs offered by MWCapital.
  2. 2. To handle your job application submitted through our website form and to manage MWCapital’s current and future recruitment processes.
  3. 3. To respond to emails received at our corporate addresses for the maintenance of institutional relationships with entities, organizations, or companies, as well as with the individuals who work or collaborate with them or with their legal representatives. 
  4. 4. o manage your registration and attendance at events or courses promoted or organized by MWCapital, as well as to manage institutional invitations to events promoted or organized by MWCapital or third parties.

Likewise, we may process your personal data for the management of ticket purchases, payment processing, and identity verification of attendees at MWCapital-organized events (such as the Talent Arena), in order to ensure secure access, prevent fraudulent ticket use, and comply with legal obligations regarding accounting and taxation.
  6. To manage and promote MWCapital’s activities, initiatives, or programs, including the capture and use of photographs and videos in various MWCapital media and social platforms, for professional and non-commercial purposes.
  7. 6. To manage advisory and citizen support projects organized by MWCapital, ensuring that the collaborators involved do not collect or retain personal data from the individuals they assist.

  

3. DATA RETENTION PERIOD: How long will we keep your data?

In the case of data related to ticket purchases and payment management, data will be retained for the legally required periods under tax and accounting regulations (normally five years) and for a reasonable period after the end of the event to address potential incidents or claims.
5. Managing and promoting activities, initiatives, or programs, including capturing and using photographs and videos in MWCapital’s media and social networks, for professional and non-commercial purposes. Until you request their deletion.
6. Handling your inquiries and providing advice regarding public or private administrative procedures.No data are retained or stored.

In cases involving ticket sales, in addition to identification and contact data, the data necessary for payment management and, if applicable, invoicing will also be processed.

  

4. LEGITIMATION: What is the legal basis for the processing of your personal data?

The legal bases for processing your personal data corresponding to each of the purposes listed in section 2 above (“Purposes”) are as follows:

Your personal data will not be disclosed to any third party, except to public bodies and authorities in cases where a legal regulation requires it. Likewise, we inform you that your personal data may be communicated to the following categories of data processors: providers of commercial communications, forms, web platforms, CRM systems, payment management, event registration and management, office software, IT maintenance and development, accounting, auditing, advisory and legal representation services, and evaluators or reviewers in internal promotion or hiring processes.

Some of these data processors may be located outside the European Economic Area; in such cases, MWCapital will ensure that the recipient countries have received an adequacy decision from the European Commission or, failing that, that the corresponding standard contractual clauses are signed.

Within the organization of events involving ticket sales or access control, MWCapital may rely on external service providers for ticketing, payment management, and access control. These providers will act as data processors under Article 28 of the GDPR and will operate under contracts that guarantee the confidentiality, integrity, and security of the processed data.

Contractual aspects related to the purchase, transfer, refund, or loss of tickets are governed by the corresponding “Ticket Purchase and Use Terms and Conditions” available during the ticket acquisition process for the relevant event.

Additionally, MWCapital occasionally organizes events in collaboration with third-party entities. In such cases, we may act as independent controllers or joint controllers with respect to the processing of personal data. This condition will be specified in each case.

In particular, the data collected through the forms available on our website for managing invitations to the Mobile World Congress (MWC) event will be shared with GSMA Ltd. for registration purposes, based on the execution of a contract. 6. RIGHTSWhat are your rights and how can you exercise them? 

At any time, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where applicable, request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, you may request the restriction of processing of your data, in which case we will only retain them for the exercise or defense of legal claims.

In certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. MWCapital will stop processing the data unless there are compelling legitimate grounds or for the exercise or defense of possible legal claims.

You may also exercise the right to data portability, as well as withdraw any consent you have given at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal.
